  1. The Promoter

The Promoter is: Borders Competitions Ltd, Company Number SC754813, whose registered office is at Borders Competitions, 3 Queen Street, Edinburgh, Scotland, EH2 1JE.

  1. The competition

2.1 These terms and conditions apply to all competitions listed on the Promoter’s website at https://borderscompetitions.co.uk (the “Website”) and to the Promoter’s membership programme, Borders Membership, described in clause 15.

2.2 The Promoter may offer different formats to the competitions. Subject to clause 2.3, an entry fee is payable each time you enter.

2.3 To be in with a chance of winning, everyone who enters the competition (an “Entrant”) may have to answer a question or solve a problem set by the Promoter (the “Competition Question”). Where the Promoter offers an easy or multiple-choice question, or where the Promoter does not ask a Competition Question, a free entry route is available.

  1. How to enter

3.1 The competition will run from and including the opening and closing dates specified on the Website. These dates shall be referred to as the “Opening Date” and “Closing Date” respectively. All times and dates referred to are the times and dates in London, England. Certain competitions may be open to Borders Members before the Opening Date shown to the public, or may be open only to Borders Members of a stated package or above, as set out in clause 15.8. Where that applies it is stated on the competition page.

3.2 If it is absolutely necessary to do so, the Promoter reserves the right to change the Opening and Closing Dates. If the Promoter does change the Opening Date and/or the Closing Date of a competition, the new details will be displayed on the Website. The Promoter will not extend the Closing Date simply to sell more entries.

3.3 All competition entries must be received by the Promoter by no later than the specified time on the Closing Date. All competition entries received after the specified time on the Closing Date are automatically disqualified and no refunds will be given.

3.4 The maximum number of entries to the competition will be stated on the Website. The number of entries you are able to make may be limited if the maximum number of entries is reached. Free entries allocated to Borders Members under clause 15.5 count towards the maximum number of entries. The Promoter may also set a maximum number of entries per person, per order or per household for any competition (an “Entry Limit”). Entry Limits are set out in clause 13.

3.5 Subject to any Entry Limit, Entrants can enter the competition as many times as they wish until the maximum number of entries have been received. Entrants submitting free entries must submit each entry separately. Bulk entries, if received, will not be accepted and will only be counted as one single entry.

3.6 To enter the competition:

All Entrants (including those entering for free) must open an account on the Website prior to entering any of our competitions. Only one account per person is permitted. An account must be opened, funded, accessed and operated only by the person named on it. If any Entrant opens or tries to open more than one account, or opens, funds, accesses or operates an account for or on behalf of another person, or allows another person to do so with their account, all of the accounts concerned will be closed and the Entrants will not be permitted to enter any of the Promoter’s competitions. Once an account has been opened, to enter the competition:

(a) go to the Website and view the Competition Question, if there is one;

(b) complete and submit the online entry form or follow the instructions on how to enter for free; then

(c) purchase the required number of entries; then

(d) when you have purchased your entries, submit your answer to the Competition Question, if there is one.

3.7 All entries must be submitted in the English language. Entries in languages other than English will automatically be disqualified and no refund will be given.

3.8 Unless you are using the free entry method, the Promoter will send confirmation that your entry has been received and confirm whether or not your answer to the Competition Question is correct (if there is one).

3.9 The Promoter will not accept responsibility for competition entries that are not successfully completed, are lost or are delayed regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.

3.10 By purchasing entries and submitting a competition entry, you are entering into a contract with the Promoter and are agreeing to be bound by these terms and conditions.

3.11 You may enter the competition for free by complying with the following conditions:

(a) Send your entry by first-class or second-class post to the Promoter at the following address:

(b) Hand-delivered entries will not be accepted and will not be entered into the random draw.

(c) Include the following information with your entry: (i) Your full name. (ii) Your address. (iii) A contact telephone number and email address. (iv) The competition you wish to enter and your answer to the Competition Question (if applicable).

(d) Incomplete or illegible entries will be disqualified.

(e) You may submit multiple free entries for any competition (up to the limit specified by the Promoter), but each free entry must be posted separately. Bulk entries sent in one envelope will only count as a single entry.

(f) By entering the competition, you confirm your eligibility and acceptance of these terms and conditions.

(g) Your entry must be received by the Promoter before the competition’s Closing Date. Entries received after this date will not be entered into the random draw. Proof of posting does not guarantee your entry will be included.

(h) The Promoter will not acknowledge receipt of your entry or confirm whether your answer to the Competition Question is correct.

(i) If the number of entries received reaches the competition’s cap or limit before your free entry is processed, your entry will not be included in the random draw.

(j) If entering via postal entry, the number of entries awarded per postcard will match the ticket value as stated in the ‘Free Postal Entry’ tab of the relevant competition. The entry fee equivalent will be credited to your account as Border Bucks (Store Credit). These credits can then be used to complete your entry. For a competition that is open only to Borders Members (clause 15.8), the Promoter will instead enter your postal entry into the competition on your behalf, so that the free entry route is available to everyone whether or not they are a member.

(k) If the cost of entry is lower than a second class stamp, postal entries will receive the value or more per postcard if entering via postal route.

(l) All postal entries must be handwritten by the entrant. Computer-generated, printed or typed entries (including printed labels or stickers bearing the entrant’s details) are not eligible and will be disqualified.

  1. Choosing a winner

4.1 The Promoter may use different methods of choosing the winner, depending on the format of the competition:

(a) Main draw: All Entrants who correctly answer the Competition Question will be placed into a draw and the winner will be chosen by random draw. If no Competition Question is asked, all Entrants will be entered into the random draw. The random draw will take place as soon as reasonably possible and, in any event, within 7 days of the Closing Date (“Draw Date”).

(b) Instant wins: All Entrants meeting the entry requirements will be randomly allocated an entry number on completion and payment of their entry. If the entry number corresponds with an instant win number stated on the Website, the Entrant will win that prize.

(c) Auto draws: The Promoter uses an automated, verifiably fair draw system (“Auto Draw”) for choosing the winner or winners of the Main draw and for allocating Instant Win prizes. Auto Draws are performed using The-RNG (the-rng.com), a draw system whose randomness is sourced from the drand distributed public randomness beacon operated by the League of Entropy (a global consortium of independent organisations including Cloudflare, EPFL and the University of Chile). An Auto Draw operates as follows:

(i) entries close at the Closing Date, or when the maximum number of entries has been sold (including the allocation of free entries and of free entries to Borders Members), whichever is sooner. No entry can be added to the draw after this point;

(ii) the final list of valid entries (the “Entry List”) is locked and recorded;

(iii) the draw is cryptographically committed to a future round of the public randomness beacon, randomness which does not yet exist anywhere at the time of commitment. When that round is published by the beacon, the winning entry or entries are determined by applying published cryptographic methods (HMAC-SHA256 and unbiased rejection sampling) to the Entry List. Neither the Promoter nor any other party can predict or influence the outcome;

(iv) the result is then published automatically, together with a public verification code and the full cryptographic record of the draw. Anyone may independently verify the result of any Auto Draw, at any time, using the verification code on the public verification page and the public draw ledger. The winning entry shown on the Website is always the entry determined by this process.

(d) Live draws: The Promoter may choose to perform the draw for some competitions during a live broadcast. In that case entries close at the Closing Date as normal, and the draw is triggered manually during the broadcast using the same verifiable Auto Draw system described in clause 4.1(c).

4.2 Timing of Auto Draws. The date and time displayed on the Website for each competition is the time at which entries close. The Auto Draw itself takes place after entries close and normally completes within a few minutes. However, because each Auto Draw involves requests to external services (including The-RNG draw service and the public randomness beacon), the exact time at which the draw completes may vary, and may occasionally be delayed by technical issues, network conditions or the availability of those services. Any such variation or delay does not affect the fairness or validity of the draw, because:

(a) the Entry List is locked when entries close and cannot be changed afterwards;

(b) the randomness used to select the winner does not exist until the moment the draw is committed; and

(c) every draw remains fully verifiable as described in clause 4.1(c), whenever it takes place.

If an Auto Draw cannot be completed automatically for any reason, the Promoter will complete the draw using the same verifiable method as soon as reasonably possible and, in any event, within 7 days of the Closing Date. The Promoter will not select a winner of a Main draw by any non-verifiable method.

4.3 Entry Lists. All Entrants will have their name and entry numbers included on the Entry List for the competition they have entered. The Entry List may be published on the Website, may be downloadable by other Entrants, and may be displayed or read out during a live draw. The names shown on the Entry List are the account holder names registered on the Website, and the entry numbers correspond to the Entry List used for the Auto Draw. Free entries allocated to Borders Members appear on the Entry List in the same way as any other entry.

4.4 No anonymous entries. Entry Lists cannot be anonymised. The Promoter does not offer an option to hide, mask, abbreviate, pseudonymise or otherwise conceal an Entrant’s name on any Entry List, and will not accept requests to do so. This is necessary so that every draw is fully transparent, independently verifiable and demonstrably fair to all Entrants. By entering any competition, you accept that your registered name will appear against your entry numbers on the Entry List. If you are not willing for your name to appear on an Entry List, you should not enter. This clause applies to the Entry List only and is separate from the publicity opt-out set out in clauses 7.4 and 10.3, which continues to be available to winners.

  1. Eligibility

5.1 The competition is only open to all residents in the United Kingdom aged 18 years or over, except:

(a) employees of the Promoter;

(b) employees of agents or suppliers of the Promoter, who are professionally connected with the competition or its administration; or

(c) members of the immediate families in households of (a) and (b) above.

5.2 By entering the competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the competition and claim the prize. If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the competition.

5.3 The Promoter will not accept competition entries that are:

(a) automatically generated by computer; or

(b) incomplete.

5.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition. This includes if you are rude or abusive to the Promoter or anyone associated with them, and includes any attempt, alone or together with others, to obtain more entries to a competition than the Entry Limit allows.

5.5 No refunds of the entry fee will be given in any event, including:

(a) if, following your entry into the competition, you subsequently find out that you are not eligible to enter the competition or claim the Prize;

(b) if, following your entry into the competition the eligibility criteria for entering the competition or claiming the Prize changes and you are no longer eligible; or

(c) if you are disqualified from the competition by the Promoter for any reason.

5.6 If the Entrant engages in:

(a) any form of fraud (actual or apparent);

(b) fraudulent misrepresentation;

(c) fraudulent concealment;

(d) hacking or interference with the proper functioning of the Website;

(e) amending, or unauthorised use of, any of the code that constitutes the Website;

(f) entering, or attempting to enter, using an account, payment card, wallet or device belonging to another person, or allowing another person to enter using the Entrant’s account, payment card, wallet or device; or

(g) repeatedly placing orders that reserve entries and then cancelling, abandoning or failing to pay for them; or

(h) any use of automated access, scraping, bots or scripts in breach of clause 14,

all of their entries will be declared void, no refunds will be given and they may be prevented from participating in any future competitions.

  1. The prize

6.1 The prize for each competition is described on the Website (the “Prize”). Details of the Prize are, to the best of the Promoter’s knowledge, information and belief, correct as at the Opening Date.

6.2 Prizes are subject to availability. The Promoter reserves the right to substitute any prize with a prize of equal or greater value. If any details of the Prize change, the Promoter will endeavour to update the Website as soon as reasonably possible.

6.3 The Promoter makes no representations and gives no warranties about the Prize, its value, its condition or any other information provided on the Website. The Promoter makes no representations and gives no warranties that the information provided on the Website is accurate, complete or up to date.

6.4 The Prize may be supplied by a third-party supplier (the “Supplier”). Details of the Supplier (if any) will be provided on the Website.

6.5 The Promoter reserves the right to substitute the prize with a cash alternative.

6.6 The prize is not negotiable or transferable.

6.7 If the Prize is a vehicle:

(a) the Promoter will, unless otherwise stated, ensure it comes with a valid MOT (if required);

(b) no insurance is included with the Prize and it is the Winner’s responsibility to ensure the vehicle is adequately insured prior to taking it on the public roads (if it is legal to do so);

(c) the Promoter has no responsibility for the Prize once it has been collected. The Winner is solely responsible for complying with all relevant laws and regulations relating to the vehicle, its operation and ensuring they operate it in a safe and responsible manner;

(d) no vehicle/road tax is included;

(e) the winner is responsible for ensuring they have the necessary licences, qualification, knowledge and experience to operate the vehicle safely and legally;

(f) the winner is solely responsible for ensuring they have all necessary safety equipment and clothing (for example, helmets, boots and gloves) and for wearing them whilst operating the vehicle.

If the Prize is a holiday:

(a) The prize does not include travel insurance, the cost of transfers to and from airports or stations, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s).

(b) You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the holiday in question on the travel dates specified. Dates once notified to the travel agent cannot be changed.

If the Prize is a property:

(a) All Entrants are responsible for making their own enquiries and carrying out their own due diligence relating to the Prize, their eligibility to enter the competition, their rights and eligibility to take ownership of the Prize and their eligibility to enter or live in the country where the Prize is located etc. All costs, fees or expenses incurred by the Entrant in making such enquiries or carrying out such due diligence shall be the Entrant’s sole responsibility.

(b) The winner of the Prize will be required to enter into a legally binding contract with either the Promoter or Supplier in order to transfer the legal title of the Prize to the winner. The terms of the contract are non-negotiable. If the winner refuses to sign or is unable to enter into any of the legal documents required to transfer ownership of the Prize to the winner within a reasonable time, the winner will be disqualified from the competition and the Prize will be forfeited. The Promoter will then be entitled to offer the prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.

(c) Due to the nature of the Prize, the date of transfer of ownership cannot be guaranteed but the Promoter will take all reasonable steps to complete the transfer of ownership as soon as reasonably possible.

  1. Winners

7.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

7.2 The Promoter will contact the winner personally as soon as practicable after the Draw Date, using the telephone number or email address provided with the competition entry. If the winner cannot be contacted or is not available, or has not claimed the Prize within 14 days of the Draw Date, the Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.

7.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the first name, surname and county of major prize winners on the Website and/or its social media platforms.

7.4 If you object to your surname, your county or a photograph or video image of you being published or made available, please contact the Promoter at [email protected]. Requests relating to a photograph or video image may be made at any time before that image is published. Requests relating to publication of your surname or county should be made prior to the Closing Date. The Promoter will honour any such request, but must still provide the information to the Advertising Standards Authority on request. For the avoidance of doubt, this opt-out does not apply to the Entry List described in clause 4.3, which will always show your registered name against your entry numbers, and it does not prevent the Promoter from publishing the winning entry number.

7.5 Where the Promoter has reasonable grounds to believe that a winning entry, or the account it was made from, may be in breach of these terms and conditions, the Promoter may withhold payment or delivery of the Prize for up to 28 days while it investigates, and may require the winner to provide proof of identity, proof of address and proof of ownership of any payment card or bank account used. If the Promoter concludes that a breach has occurred, the Prize is forfeited and clauses 5.5, 5.6 and 12.4 apply.

  1. Claiming the prize

8.1 You must claim the Prize personally. The Prize may not be claimed by a third party on your behalf. Details of how the Prize will be delivered to you (or made available for collection) are published on the Website.

8.2 If your personal details, including contact information, change at any time you should notify the Promoter as soon as reasonably possible. Notifications should be sent to the Promoter via email to [email protected]. Notifications must include details of the competition you have entered, your old details and your new details. If your details change within 10 days of the Closing Date, the Promoter will use your old details if it needs to try to contact you.

8.3 Any Cash Prize will be transferred directly to the winner’s nominated bank account. The winner must provide evidence that it is the sole or joint beneficiary of the bank account. Failure to do so within 14 days will result in disqualification from the competition and the winner forfeiting the prize. In such circumstances, the Promoter reserves the right to offer the prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.

8.4 The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the prize.

8.5 On the Live Draws where we pick a winner, the winner of the prize draw may be contacted via telephone and broadcast on our Live Draws. If you would prefer not to be contacted on air or recorded, you may tell the Promoter at any time and your Prize will not be affected in any way.

  1. Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

  1. Data protection and publicity

10.1 By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition or as otherwise set out in the Promoter’s Privacy Policy, a copy of which is available on the Website.

10.2 By entering the competition, you agree that your registered name will be published on the Entry List in accordance with clauses 4.3 and 4.4. If you are the winner of the competition, you also agree that the Promoter may use your name, image and town or county of residence to announce the winner of this competition, and you agree to participate in any reasonable publicity required by the Promoter, subject to clause 10.3.

10.3 If you do not wish to participate in any publicity, or do not wish a photograph or video image of you to be published, you must notify the Promoter and the Promoter will not use that material. This will not affect your chances of winning the Prize and will not affect your entitlement to the Prize. If you do not agree to participate in any publicity about the competition we may still provide your details to the Advertising Standards Authority. This is a legal requirement that we must comply with to prove that the competition has been properly administered and the Prize awarded. This clause does not allow you to be removed from, or anonymised on, an Entry List.

10.4 If you are the winner of the competition, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Prize and transfer ownership of the Prize to you. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such way but by doing so you may prevent the Prize being transferred to you. In such circumstances, you will be deemed to have withdrawn from the competition and forfeit the Prize. You will not be entitled to any refund of your entry fee. The Promoter reserves the right to offer the Prize to the next eligible Entrant selected from the correct entries that were received before the Closing Date.

10.5 Please note that under data protection laws you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request you will be withdrawing from the competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry fee if you withdraw from the competition. If you do not wish any of your personal details to be used by the Promoter for promotional purposes, please email the Promoter at [email protected] prior to the Closing Date.

10.6 To administer competitions fairly and to detect and prevent breaches of these terms and conditions, the Promoter records and analyses technical and payment information relating to each account and order, including IP addresses, device and browser information, payment card identifiers provided by its payment processor, and the timing of orders. This information may be used to identify accounts that are linked to one another under clause 13.

10.7 If you join Borders Membership, the Promoter also holds your membership package and status, the payment card details saved for recurring billing (held by the Promoter’s payment processor, not by the Promoter), the date of birth you record under clause 15.14, your merchandise size and delivery address where relevant, and messages you send through the priority support facility. This information is used to administer your membership and its benefits, to confirm your eligibility, and to tailor the Promoter’s communications and offers, as set out in the Privacy Policy.

  1. General

11.1 The Promoter reserves the right to amend these terms and conditions from time to time. The latest version of these terms and conditions will be available on the Website. Changes to Borders Membership prices or benefits are dealt with in clause 15.13.

11.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition and any future competitions.

11.3 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. There is no minimum number of entries and the Promoter will not hold void, suspend, cancel, or amend the prize competition due to a lack of entries.

11.4 The competitions on the Website are in no way sponsored, endorsed, administered by or associated with Facebook. By entering the competitions, Entrants agree that Facebook has no liability and is not responsible for the administration or promotion of the competitions.

11.5 These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.

11.6 The competitions on the Website are in no way sponsored, endorsed, administered by or associated with Apple. By entering the competitions, Entrants agree that Apple has no liability and is not responsible for the administration or promotion of the competitions.

11.7 The customer accepts full responsibility for accurately entering their account number and sort code for cash withdrawals. Borders Competitions is not liable for funds sent to incorrect accounts due to errors in the provided banking details.

11.8 The Customer must withdraw a minimum amount of £5.00 when requesting a cash prize withdrawal. Requests below this amount will not be processed.

11.9 If a Customer requests to delete their account, any active Borders Membership must be cancelled first. Once the account is deleted, all associated data will be permanently deleted, including active tickets, wallet balances and any membership benefits not yet used, which cannot be recovered or refunded. Please take care.

  1. Border Bucks and accounts

12.1 Border Bucks is the Promoter’s name for its site credit. Each Border Buck is worth £1. Border Bucks may be won in some of the Promoter’s competitions. For example, you will often see them as instant win prizes. So, if you win £100 Border Bucks, you have won £100 worth of credit to spend on our website. Border Bucks are also credited to Borders Members each month under clause 15.6.

12.2 Entrants can also purchase Border Bucks and store them in their account wallet.

12.3 Border Bucks cannot be withdrawn from your account wallet or exchanged for cash, except where clause 15.9 applies to a member of an eligible Borders Membership package. Border Bucks can only be used to purchase entries into the Promoter’s competitions. Border Bucks can be used for full or part payment. If an Entrant does not have sufficient Border Bucks to complete a payment they can pay the balance using a credit or debit card. Border Bucks cannot be used to pay for a Borders Membership.

12.4 Only one account is permitted per registered person. Any individual found to be creating, operating, funding or entering competitions using more than one account, or using another person’s account, payment card, wallet or device to enter, or allowing their own account, payment card, wallet or device to be used by another person to enter, will be in breach of these Terms and Conditions. The Promoter reserves the right to permanently suspend or ban such individuals and remove or cancel any active entries associated with those accounts without refund, and to treat all accounts concerned as Linked Accounts under clause 13.

12.5 When requesting a withdrawal, Entrants will be required to enter their bank account details via the withdrawal page. By submitting a withdrawal request, the Entrant confirms that the bank details entered are accurate and belong to them.

12.6 The Promoter accepts no responsibility for payments sent to incorrect bank accounts where inaccurate or incorrect details have been provided by the Entrant. Once a withdrawal has been processed and sent to the bank details supplied, the Promoter cannot reverse or recover the funds.

12.7 Account names must be the Entrant’s own true name. The Promoter may require proof of identity and may correct, suspend or close any account that does not comply.

12.8 Payment cards, Apple Pay, Google Pay and other payment methods used on an account must be in the name of the account holder. The Promoter may decline any payment, cancel any entry and suspend any account where a payment method is used that does not belong to the account holder or that has been used on another account.

12.9 You should print a copy of these terms and conditions and keep them for your records.

  1. Entry Limits and Linked Accounts

13.1 Entry Limits. For any competition the Promoter may state a maximum number of entries per order, per person, or both. Unless a competition states otherwise, any per-person Entry Limit also applies per household, so that the total entries made by all members of one household do not exceed that limit. Entry Limits exist to keep low-ticket competitions fair for all Entrants. Free entries allocated to Borders Members are dealt with in clause 15.5.

13.2 Household. For the purposes of these terms and conditions, a household means all persons who share any of: a residential address; an internet connection; a payment card, wallet or other payment method; or a device used to access the Website.

13.3 Linked Accounts. The Promoter may treat two or more accounts as Linked Accounts where it has reasonable grounds to believe they are operated by the same person, by members of the same household, or by persons acting together. Reasonable grounds include, without limitation, any of the following:

(a) the same payment card, wallet or other payment method being used on more than one account;

(b) orders on more than one account being placed from the same device, or from the same internet connection within a short period of time;

(c) accounts sharing a residential address, telephone number or email address, or accounts whose billing details have been changed to match one another;

(d) accounts being registered from the same device or within a short period of one another;

(e) a pattern of orders on more than one account being placed on the same competition within a short period of one another;

(f) accounts that receive, share or act on information obtained by automated means in breach of clause 14.

13.4 Coordinated entry. Entrants must not act together, whether as a household, a syndicate or otherwise, to obtain more entries to a competition than the Entry Limit allows. Where Linked Accounts have together exceeded an Entry Limit, the Promoter may treat all entries from those accounts to that competition as invalid.

13.5 Consequences. Where accounts are Linked Accounts, the Promoter may, at its sole discretion, do any of the following in respect of any or all of them: suspend or permanently close the accounts; cancel any active entries without refund; withhold any Prize not yet paid or delivered; recover or offset any Prize paid in the period in which the breach occurred; and refuse any future registration by the persons concerned. The Promoter is not required to establish which individual placed any particular order.

13.6 Reserved entries. When an order is placed, the entries in that order are reserved for the Entrant for a short period while payment is completed. If payment is not completed within that period, the reservation is released. Repeatedly placing orders that reserve entries and then cancelling, abandoning or failing to pay for them is interference with the proper functioning of the Website under clause 5.6(d).

13.7 Investigation. Where the Promoter is investigating a possible breach of this clause 13, it may suspend the accounts concerned and withhold any Prize under clause 7.5 while the investigation is carried out. The Promoter may require any account holder to provide proof of identity, proof of address, and proof of ownership of any payment card, wallet or bank account used on the account. Failure to provide that proof within 14 days of the request is itself grounds for the Promoter to treat the accounts as Linked Accounts.

13.8 The Promoter’s decision on whether accounts are Linked Accounts, and on the consequences under clause 13.5, is final in accordance with clause 7.1.

  1. Automated access and fair use of the Website

14.1 The Website is provided for personal use by Entrants through a normal web browser or the Promoter’s app. You must not use, or allow anyone else to use on your behalf, any bot, script, scraper, crawler, browser extension, automation tool or other automated means to access the Website, to monitor competitions, ticket availability, instant win prizes or odds, to place or reserve entries, or to collect any data from the Website.

14.2 You must not use, subscribe to, purchase or act on information about the Promoter’s competitions that has been obtained by any person using automated means in breach of clause 14.1, including third-party odds trackers, alert services or shared feeds of competition data.

14.3 You must not take any action that places an unreasonable load on the Website, including repeatedly refreshing or requesting competition pages at a rate that no ordinary Entrant would, or circumvent any rate limit, security measure or bot protection used by the Promoter.

14.4 The Promoter may treat any of the following as reasonable grounds that this clause 14 has been breached: request rates, page view counts or session patterns that are inconsistent with ordinary human use; access from data centre, hosting, proxy or VPN infrastructure rather than a residential or mobile connection; requests that bypass or interfere with the Promoter’s bot protection; or orders placed within seconds of an instant win prize or ticket becoming available in a manner consistent with automated monitoring. The Promoter is not required to identify the specific tool used.

14.5 Where the Promoter has reasonable grounds under clause 14.4, it may, at its sole discretion and without notice: block or restrict access from any IP address, device or connection; suspend or permanently close the accounts concerned; cancel any active entries without refund; withhold any Prize not yet paid or delivered under clause 7.5; and treat the accounts concerned as Linked Accounts under clause 13. Clauses 5.5, 5.6 and 7.1 apply.

14.6 Nothing in this clause prevents an Entrant from viewing competitions on the Website as often as they wish using a normal browser or the Promoter’s app, or from using accessibility tools that do not collect data or place entries automatically.

  1. Borders Membership

15.1 What it is. Borders Membership is an optional monthly subscription offered by the Promoter in packages (currently Borders Club, Borders VIP, Borders Elite and Borders Black; each a “Package”). The current Packages, prices and benefits are those shown on the Website at https://borderscompetitions.co.uk/membership/ (the “Membership Page”). Borders Black is available by invitation from the Promoter only. A person who holds an active membership is a “Borders Member”. Membership is not required to enter any competition, and does not change the odds of winning any competition other than through the additional entries described in clause 15.5.

15.2 Eligibility. Membership is open to account holders who meet the eligibility requirements in clause 5, including being 18 or over and resident in the United Kingdom. One membership per account, and one account per person (clause 12.4). The Promoter may ask for proof of age and identity at any time, and may cancel a membership without refund where the member is found not to be eligible.

15.3 Billing. Membership is billed monthly in advance to the payment card saved to your account, first on the day you join and then on the same day of each following month (your “Renewal Date”). By joining you authorise the Promoter to take each monthly payment automatically from that card. If a payment fails, your membership benefits are suspended until the payment is made; you can retry the payment or update your card from My Account. Membership payments are not counted towards any spending limit set on your account. Border Bucks cannot be used to pay for a membership and discount codes cannot be applied to a membership.

15.4 Starting immediately, and the cooling-off period. Your membership benefits, including the Border Bucks credit in clause 15.6, are provided immediately when your first payment is taken. By joining you expressly request that the service begins immediately and acknowledge that, once the Border Bucks for a month have been credited, that month’s payment is not refundable. You may cancel at any time under clause 15.11.

15.5 Free competition entries. Each Package includes a stated number of free entries into each competition the Promoter designates as a Star Prize competition while your membership is active. Free entries are allocated automatically, normally within an hour of the competition opening or of you joining or upgrading, and carry entry numbers in the same way as purchased entries; they appear in your order history and on the Entry List. Free entries are in addition to any entries you purchase and do not count towards a per-person or per-household Entry Limit under clause 13, but they do count towards the maximum number of entries for the competition, and no free entries will be allocated once that maximum has been reached. The Promoter may set a different number of free entries, or none, for a particular competition, in which case this is stated on the competition page. Free entries have no cash value, are not transferable and are not refundable if your membership ends.

15.6 Border Bucks. Each Package includes a stated amount of Border Bucks, credited to your account wallet each time a monthly membership payment is successfully taken. These are Border Bucks under clause 12 and, except as set out in clause 15.9, cannot be withdrawn or exchanged for cash. Border Bucks already credited are yours to keep if your membership is paused, changed or ends. Where you upgrade part way through a month, the additional Border Bucks credited for that month are in proportion to the upgrade charge paid under clause 15.10.

15.7 Member discount. Each Package includes a stated percentage discount on the price of competition entries, applied automatically at checkout, up to a stated maximum discount per calendar month for that Package. The maximum resets on the first day of each calendar month. The discount does not apply to competitions the Promoter marks as excluded from discounts, to free entries, to wallet top-ups or to membership payments, and it is not combined with any discount code applied to the same order.

15.8 Early access and members-only competitions. The Promoter may allow Borders Members to enter certain competitions for a stated period before those competitions open to the public, with the length of that period depending on the Package. Early access is administered entirely through the Website and does not affect the free entry route in clause 3.11, which applies to those competitions in the normal way once they are open to the public. The Promoter may also designate certain competitions as open only to Borders Members of a stated Package or above. Where early access or a members-only restriction applies it is stated on the competition page. For a competition that is open to members only, the free postal entry route in clause 3.11 remains available to everyone, whether or not they are a member, and postal entries to such competitions will be entered into the competition by the Promoter on the Entrant’s behalf.

15.9 Converting Border Bucks to cash. Members of the Packages stated on the Membership Page (currently Borders Elite and Borders Black) may convert Border Bucks in their wallet into cash credit, from My Account. A percentage of the amount converted is deducted, and a minimum amount per conversion and a maximum amount per calendar month apply; the current deduction, minimum and maximum are shown on the conversion page before you confirm. A conversion cannot be reversed once confirmed. Converted cash credit is paid out through the normal withdrawal process in clauses 12.5 and 12.6, and clauses 11.7 and 11.8 apply. The Promoter may change or withdraw this benefit in accordance with clause 15.13.

15.10 Changing Package. You can upgrade or downgrade between Packages from My Account. An upgrade takes effect immediately: you pay the difference between the two Packages for the days remaining in your current month, and the new monthly price applies from your existing Renewal Date. A downgrade takes effect from your next Renewal Date and nothing is charged at the time of the change. Borders Black cannot be selected as an upgrade; it is by invitation only.

15.11 Cancelling. You can cancel at any time from My Account. Your benefits continue until the end of the month you have already paid for, after which no further payments are taken and your membership ends. No refund is given for any part of a paid month. You can rejoin at any time, subject to clause 15.18.

15.12 Pausing. Where the Promoter offers pausing, you may pause your membership from My Account a limited number of times in any twelve-month period, as stated in My Account. While paused, no payment is taken and no benefits are provided: no Border Bucks are credited, the member discount does not apply, no free entries are allocated and your membership is not shown on the Website. When you resume, benefits restart immediately and your next payment is taken on the next Renewal Date in your normal billing cycle.

15.13 Changes to Packages. The Promoter may change the price or the benefits of a Package. The Promoter will give existing members of that Package at least 30 days’ notice by email before a price increase or a reduction in benefits takes effect, and you may cancel before it takes effect under clause 15.11. The Promoter may add to or improve benefits at any time without notice, and may withdraw a Package from new members at any time without affecting existing members’ current month.

15.14 Birthday Border Bucks. Packages may include a stated amount of Border Bucks credited on your birthday in each year in which you are a Borders Member on that day. To receive it you must record your date of birth in My Account. The date of birth you record must be your own; it is used to confirm that you are 18 or over and cannot be changed by you once saved. If it is wrong, contact the Promoter. The credit is made once per birthday and is not made retrospectively for a birthday that has already passed when the date is recorded.

15.15 Merchandise. Where a Package includes an item of merchandise, it is provided after the stated number of paid months on that Package, once per member per Package, in the size you select in My Account, delivered to the address on your account within the United Kingdom. Items are subject to availability and the Promoter may substitute an item of similar value. Merchandise has no cash value, is not transferable and cannot be exchanged for Border Bucks or cash.

15.16 Member votes. The Promoter may invite Borders Members to vote on prizes, merchandise or events. Votes are advisory: the Promoter will publish the result but retains sole discretion over what is offered, subject to clause 6. The Promoter may weight votes by Package where stated on the vote.

15.17 Priority support and priority payouts. Where a Package includes priority support, the Promoter will treat messages sent through the priority support facility in My Account as priority, but does not guarantee a response time. Where a Package includes priority payouts, the Promoter will aim to process that member’s prize payments ahead of other prize payments, subject to clauses 7, 8 and 13. This does not change the amount of any Prize or the Promoter’s right to verify a win before paying it.

15.18 Misuse. Membership benefits are for the personal use of the account holder. The Promoter may suspend or cancel a membership without refund where the account is used in breach of these terms and conditions, including clauses 5.6, 12.4, 13 and 14, or where benefits are obtained through error or abuse, including repeatedly joining and cancelling, or changing Package, to obtain Border Bucks, free entries or other benefits more than once for the same period. The Promoter may refuse to accept a new membership from a person whose membership has previously been cancelled under this clause.

15.19 Publicity and Entry Lists. Nothing in this clause 15 changes clauses 4.3, 4.4, 7.3 or 10. Free entries allocated to Borders Members appear on the Entry List in the same way as any other entry.

15.20 Priority of terms. If there is any conflict between this clause 15 and the description of a Package on the Website, the Website description of the current benefits applies to the benefits and these terms and conditions apply to everything else.
